These terms and conditions apply to use of Bespoke Spots websites found at www.bespokespots.com.

The terms and conditions specifically refer to the following products and services which may be purchased or accessed via our website:

  • Subscriptions
  • Special Offer Vouchers

Throughout these terms and conditions, the above products and services are referred to as Subscription and vouchers.

  1. Making a purchase

When you purchase a subscription or voucher and tick the box “I understand the terms and conditions” you become legally bound by these terms and conditions and the Bespoke Spots Privacy Policy. Please do not processed to purchase/use unless you understand, read and accept the terms and conditions. You are also agreeing to the terms and conditions of the voucher or “Special Offer” provided by the Vendor.

When you make a purchase on behalf of another individual (such as purchasing a voucher for them) and you provide us with their personal information, you warren that you are authorised to provide us with that personal information and that we are able to use that personal information for the purposes set out in our privacy policy, This information would include such things as their email address, phone contact number etc.

Please note the subscriptions purchased on our site reflect the currency of your place of business. If you are purchasing a voucher, the currency will reflect the currency from the place of purchase not the place of redemption.

  1. Registration and user requirements
  • You must be a registered member to access some features of the Website or our services. When you register, you will provide us with personal information including your name, address, and a valid email address. You must ensure this information is accurate and current.
  • By using the Website and its associated functionality, you grant your express consent to us to send you direct marketing communications to the email address you provide, from which you may unsubscribe at any time. Your consent to receipt of certain communications may be implied from the use of certain functional aspects of our service, such as receiving reminders that items are in your shopping cart if you leave the page during a transaction.
  • To register an account or to use the website you must be at least 18 year old.
  1. Refunds
  • There are no refunds available for subscriptions once payment has been processed and received.  You (the provider) are able to cancel your subscription at any time however payment will not be refunded. 
  • 14 day change of mind policy applies only to vouchers purchased from the “Special Offer” page on the Bespoke Spots website. Refunds are only available to vouchers that have not been redeemed ie. where the voucher owner (member) has yet to contact the provider of the voucher to redeem the voucher purchased.  Once you have requested the booking or redeemed the voucher a refund will not be issued.
  • The refund will only be processed back to the purchased and refunded back to the credit card used to purchase the voucher.
  • After the lapse of 14 days a refund will not be issued.
  1. Prices

The prices of vouchers include all taxes and charges, including GST or VAT (where applicable) except where stated otherwise. There may be additional surcharges which are payable directly to the provider which will be referred to in the relevant voucher. Prices of products and services are current at time of display however are subject to change.

The prices of both vouchers and subscription include all taxes and charges, including GST or VAT (where applicable) where stated otherwise. There may be additional surcharges which are payable directly to service providers for the service of Vouchers, where applicable. 

Bespoke Spots charges a transaction fee to recover the costs it incurs for the card payments and (payment account). Bespoke Spots charges no fees for using debit cards. Transaction fees will not be returned to a member/purchaser if a refund is issued. 

  1. Voucher Extension

If you require an extension on your pre-purchased voucher, you will be required to contact the service provider. It is the service provider discretion to either extend the voucher or provide another solution.

Voucher delivery via email:

Bespoke Spots is not liable or responsible for any loss suffered as a result of a voucher via email being blocked by filters or firewalls, or where the incorrect email address has been entered by the purchaser. If the recipient does not receive the email with the voucher, please contact us to resend the voucher to an alternative email address. 

  1. Provider of the Voucher

Nothing in these terms (including the exclusions and limitations in this section 5) excludes, restricts or modifies any guarantee, right or remedy that under the law cannot be excluded, modified or restricted such as your statutory consumer guarantee rights, including under the Australian Consumer Law (for more information see section 2 and section 6):

Subject to the following:

  • Vouchers sold by Bespoke Spots as an agent for businesses that provide lifestyle and recreational services to customers (“Service Providers”).
  • Bespoke Spots provides vouchers and the contract with Bespoke Spots is not finalised until the voucher has been fulfilled by the Service Provider.
  • Bespoke Spots is not a provider of experiences and Bespoke Spot Providers will provide these services directly with the customer.
  • Bespoke Spots make no warranty or representation regarding the standard of any service to be provided to you by the experience Provider.
  • Bespoke Spots issues vouchers based on the individual terms and conditions listed on the vouchers before purchase and these terms and conditions.
  • Bespoke Spots does not control the business operations of any Service Provider.
  • Bespoke Spots make no guarantees or warranties about the services that are provided to you by the Service Provider.
  • The Service provider will provide the best price and discount only available to Bespoke Spots Members.
  1. Availability of Service/Vouchers

All services offered by the Experience Provider subject to availability. Bookings are recommended to be made at least 4 week in advance (if required). If you would like to book during peak times (such as weekends or holidays) you should contact the Service Provider and book further in advance. Bookings or confirmation of the services are not confirmed until you have received a separate confirmation from the “Service Provider”.

In the event that a booking specifies a “book by” date, all bookings must be made with the Vendor prior to that date.

Any terms and conditions of the vendor will always apply in addition to any specific terms of the offer state by Bespoke Spots. For example, if a service provider is not open on certain days, the voucher will not be redeemable on those days. Refunds are not payable in the event that you are unable to use a voucher on the account of the service providers usual terms and conditions.

The vendor has the right to decided when a voucher can be redeemed unless a booking is made prior to a booking date.

  1. Capacity

By making a purchase of a voucher or subscription on the website you warrant that you are over 18 and that you have the right and ability to enter into a legally binding agreement with us.  No person under the age of 18 are permitted to use the website or to sign up as a member of the website

  1. Contact Details Given to Service Provider

It is your responsibility to ensure you enter your email address and other contact details correctly when you complete the voucher payment process on the Bespoke Spots website. As the Service Provider will be expecting you, you may end up receiving an email from the Service Provider with separate instructions on how to claim your voucher.

  1. Voucher Cancellation after booking

Once the booking has been made with the Service Provider then the Service Provider terms and conditions will become effective.  Our service providers have their own terms and conditions and policies which you are bound to follow. To cancel or modify your booking will need to be made directly with the service provider.

  1. Complaints or problems

If you have any questions, problems or complaints on the day of your booking or your service, please bring this to the service provider’s attention immediately so that issues may be addressed on the spot where possible.

  1. Insurance

Some of the services that we promote as an agent are considered dangerous. Prior to participating or ordering your voucher to any service you should be aware, if applicable of the risks involved. If the service warrants, they will maintain appropriate public liability insurance for all risks associated with its business and service provisions.

  1. Information security

Bespoke Spots has taken reasonable steps to keep information secure, breaches may occur. In the event of a security incident we have in place procedures to promptly investigate the incident and determine if there has been a data breach involving personal information, and if so, to assess if it is a breach that would require notification. If it is, we will notify affected parties in accordance with Privacy Act requirements.

  1. Links to third party websites

The Bespoke Spots website may include links to other websites, content or resources.  These linked websites, content or resources may be operated by third parties and we may have no responsibility or control over them.

The existence of these links does not imply that we endorse the linked website, content or resource. You acknowledge that we have not reviewed any of these third party websites, content or resources and we are not responsible for the material contained therein.

  1. Social Media Content
  • You understand that all information, such as comments, messages, text, files, images, photos, video, sounds and other materials (“content”) posted on, transmitted through or linked from the Website, our Facebook page, Instagram, Twitter feed, or forum or other like application or site that allows for the publication of user generated material (“Social Media”), is the sole responsibility of the person from whom such content originated.
  • You understand that we do not control and are not responsible for content made available through the Website or Social Media unless it originates from us. Consequently, by using the Website or our Social Media pages you may be exposed to content provided by third parties that is offensive, indecent, inaccurate, misleading or otherwise objectionable. You use the Website at your own risk and to the extent permissible at law we do not accept liability in this regard.
  • As a member or participant on our social media pages, you agree that you are responsible for any content submitted, posted or made available through the website and you must not post (or allow) content to be posted that; you do not have the right to post, is misleading or deceptive,  is offensive or discriminates against any group of persons being a group defined by reference to colour, race, sex, origin, nationality or ethnic or national origins; denounces religious or political beliefs, is indecent, obscene, vulgar, pornographic or offensive.
  1. Intellectual property

We reserve the intellectual property rights, including but not linked to, copyright in material and/or services provided by us. Nothing in the agreement gives you a right to use any of our marketing material, business names, trademarks, logos, domain names or other distinctive brand features.

  1. Customer ratings and reviews of use

We encourage you to leave feedback and reviews on all our service providers. 

All submitted content is subject to these terms and conditions.  If we decided that the feedback or the review is not following or suitable we will remove the content from our website.

  • You are the sole author and owner of the intellectual property rights of the content of your review and that the content of your review does not infringe any third party’s copyright, patent, trademark, trade secret or other proprietary rights or rights of the publicity or privacy.
  • For any content that you submit, you grant Bespoke Spots a perpetual, irrevocable, royalty free, transferable right and licence to use, copy,  modify, delete in its entirety, adapt, publish, translate, create derivative works from and/or sell and/or distribute such content and/pr incorporate such content into any form, medium or technology throughout the world without compensation to you.
  • All “moral rights” you may have in such content have been voluntarily waived by you (including rights of attribution or integrity) that may subsist in your content and agree you have no objection to the publication, use, modification, deletion or exploitation of your content by Bespoke Spots.
  • You are at least 18 years of age if completing a review for an experience that includes alcohol.
  • You have not been compensated or granted any consideration by ay third party for your review, and that you are providing your review in good faith and in the spirit in which the process is intended.
  • The content you provide to RedBalloon: is not false, inaccurate or misleading; does not violate any law, statute, ordinance or regulation (including, but not limited to, those governing export control, consumer protection, unfair competition, anti-discrimination or false advertising) does not contain any content which is defamatory, libelous, hateful, racially or religiously biased or offensive, unlawfully threatening or unlawfully harassing to any individual, partnership or corporation; does not contain any computer viruses, worms or other potentially damaging computer programs or files; and
  • The content you provide does not contain any of the following types of content or violates other guidelines: Obscenities, discriminatory language, or other language not suitable for a public forum; advertisements, “spam” content, or references to other products, offers, or websites; email addresses, URLs, twitter handles, phone numbers, physical addresses or other forms of contact information; critical or spiteful comments about other reviews posted on the page or their authors.
